SERVICE CONTRACT

 

 

This Service Contract (the "Contract") is entered into between Your Floor (the "Company") and the undersigned customer (the "Customer") for the provision of flooring services as outlined in the agreed-upon estimate or invoice.

 

Period of Performance

Completion days: as estimated on the invoice/estimate.

Estimate could change upon discovery of the need for additional work and/or materials once the project has started. All work is estimated by a total contractual sum; consequently, line items should not be used as price estimates for a particular line item. Any alterations or deviations from the above specifications involving extra costs will be executed only upon written consent by customer and will become an extra charge over and above the estimate. All agreements, contingent upon strikes, accidents, or delays are beyond our control.


 

Payment Terms, Refund Policy, And Final Walk-Thru

    • The Customer shall pay a 50% deposit before work commences, with the remaining 50% balance due upon project completion.
      • The Customer may make the deposit payment for services rendered by [Company Name] via check, credit card, or cash. The Customer agrees to authorize Company to charge the provided credit card for the final payment after the 48-hour walk-through inspection, provided that no punch list is generated from the walk-through. Should there be no outstanding items to address, the Customer acknowledges and agrees to the final payment being processed via the provided credit card. In the event the Customer opts to make the deposit via check or cash, the final payment will still be processed as described above unless otherwise agreed in writing.
    • If any balance remains unpaid beyond 30 days, the Customer agrees to pay a 35% collection fee of the total contracted amount.

Refund Policy:

    • All sales are final upon receipt of payment by the Company. No refunds or exchanges will be issued.
    • Any amendments to the contract must be mutually agreed upon and initialed by both parties before taking effect.

Final Walk-Thru:

    • The Customer is responsible for conducting a walk-thru upon completion of the project.
    • Any Punch List items or concerns must be submitted in writing via email at [email protected] within 48 hours of project completion.
    • If the final balance is not paid within five (5) days of completion, any applicable discounts will be voided.
    • The Customer may retain up to 7% of the contracted amount if a Punch List is documented upon completion.

Amendments to Terms:

    • Any modifications to the Terms of Service may be reflected in the estimate, as approved by a Your Floor representative.

Progressive Payment Plan
If the project is completed in multiple stages, the Customer agrees to the following payment schedule:

    • 50% Deposit – Required before the commencement of work.
    • 20% Payment – Due upon the completion of the installation phase.
    • 20% Payment – Due after refinishing and the application of two (2) coats.
    • 10% Final Payment – Due upon the completion of the final coat.

Failure to adhere to this payment plan may result in work stoppage and/or additional fees. Let me know if you need any modifications!


Non-Solicitation of Employees/Contractors: 

Customer agrees that they will not, either during the working period or at any time thereafter, hire nor attempt to solicit or influence any of Your Floor employees or contractors to:

    1. become employees or contractors of, or render services to, homeowner or any other employer or business;
    2. engage in any activity, business or undertaking not sponsored by Your Floor; or
    3. engage in any activity contrary to or conflicting with the interests of Your Floor, while the employee or contractor is employed at or retained by Your Floor. 

Binding Effect:  

This Agreement shall extend to, shall inure to the benefit of and shall be binding upon all the parties here to and upon all of their respective heirs, successors and representatives. Should customer breech this agreement, customer agrees to a fine of ten thousand dollars.


Your Floor Construction Arbitration Clause 

Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Atlanta, GA 1201 W Peachtree, NW, Suite 2650, Atlanta, GA 30309, before one arbitrator. The arbitration shall be administered by JAMS pursuant to its (Engineering and Construction Arbitration Rules & Procedures) (Engineering and Construction Arbitration Rules & Procedures for Expedited Arbitration). Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Customer agrees to cover all mediation costs. 


FURNITURE:

    • If the Customer has made arrangements with Your Floor to move furniture, the Customer is responsible for moving all knick-knacks, shoulder-height paintings, electronics, and breakable items. Hutches and china cabinets must be emptied prior to moving.
    • Your Floor does not move grand pianos, grandfather clocks, or priceless family heirlooms. These items should be handled by a professional moving service hired and scheduled by the Customer.
    • The Customer is responsible for providing a designated space for furniture storage (e.g., garage) and must supervise and direct the moving process.
    • Your Floor will handle all furniture and appliances with maximum care but assumes no liability for any damages that may occur. The contracted price for furniture moving is non-negotiable.

Moving Appliances:

    • Your Floor will move and work around appliances with maximum care but cannot assume liability for any damages that may occur during the process. Should the Company move appliances there will be an additional appliance fee of $199/appliance.
    • To ensure full protection of appliances, it is recommended that the Customer arranges for them to be moved out of the work area.
    • Your Floor does not move Sleep Number beds.

Liability:

    • Your Floor will perform all work with the highest level of care; however, the Company is not liable for any damages to the property. Due to logistical constraints, pre-existing damages and wear-and-tear cannot be documented for every project.
    • If no prior arrangements have been made with Your Floor to move furniture, the Customer is responsible for ensuring the workspace is completely empty before work begins.

Pre-Finished Wood Flooring And Third-Party Product Installation 

    •           When ordering pre-finished wood flooring through Your Floor, an additional 7%-10% of materials will be ordered to account for waste, with quantities rounded to the next full box of wood. As a result, the Customer may have 1-3 extra boxes of wood flooring remaining upon project completion. It is recommended that the Customer retain these extra materials for future repairs. Should the Customer choose to return any unused boxes, a 35% restocking fee will apply, as per the manufacturer’s policy. Returned boxes must remain intact and in their original condition.
    •          Your Floor will install flooring products sourced from other retailers or distributors; however, Your Floor does not provide any warranty on such installations. The Customer acknowledges that any warranty claims related to third-party products must be addressed directly with the product manufacturer or distributor.

Rescheduling

·       If the customer needs to change the scheduled start date of the project, a minimum of 24-hour notice is required. Failure to provide proper notice will result in a $199 rescheduling fee, which must be paid before a new start date is confirmed.


Contract Termination Clause
In the event that the Customer desires to terminate this Agreement at any time after it has been executed, the Customer shall incur a penalty equal to 10% of the total contracted amount. Exceptions to this penalty are as follows:

    1. A natural disaster that significantly impacts the Customer’s ability to fulfill the terms of the Agreement.
    2. Scheduled closing dates that render the Agreement void.
    3. Life-threatening situations that prevent the Customer from performing or continuing the Agreement.

Installation Of Hardwood Floors

    • Wood Floor Expansion & Contraction: Solid wood floors naturally expand and contract with seasonal changes. As such, Your Floor does not warrant against expansion and contraction in its wood floor installations.
    • Laminate Floor Installation: Laminate floors are installed using a floating floor system, meaning they are not glued down but rest on top of the sub-floor. Due to this method, customers should expect the flooring to feel slightly softer underfoot with some natural give.
      • If the sub-floor is unlevel, a leveling compound can be applied at an additional cost to improve the flooring surface.
    • Adding New Wood Floors: All additional wood flooring will be installed using a T-mold transition unless otherwise specified by the customer.
    • Stone Fireplace Installations: When installing flooring around a stone fireplace, Your Floor will create a picture frame border around the base and fill any remaining gaps with mortar. However, an exact mortar color match cannot be guaranteed.
    • Squeaky Sub-Floors: Your Floor will install screws in areas where squeaks are detected by our crew. However, we strongly recommend that customers identify and point out squeaky areas to our team during the installation process. Your Floor cannot guarantee the complete elimination of all squeaks.
    • New Staircase Installation & Refinishing:
      • For new step installations, Your Floor will use solid oak treads stained to the customer’s preference and quarter-inch veneer risers, which can either be stained or primed.
      • On built-in staircases, Your Floor will install a retro tread over the existing step and sand and paint the skirt sides using paint provided by the customer.
      • Our team will take the utmost care around existing wood or iron spindles to avoid damage. However, if any spindles need to be replaced, Your Floor will provide labor at no cost as long as the customer supplies the new spindles.
      • Any touch-up paint work required after step installation or refinishing will be the customer’s responsibility.
    • Liability for Trim, Cabinetry & Paint: Your Floor will perform all work with maximum care. However, Your Floor is not responsible for any pre-existing or newly occurring damages to trim, cabinetry, or paint before, during, or after floor installation or refinishing.

Refinishing Floors

Stain Selection:
The Customer or an authorized representative must be present on the first day of sanding to approve the stain color. If the Customer is unavailable on the scheduled day, it is the Customer's responsibility to make an appointment prior to leaving town to select a stain color.

Color Matching:
Your Floor will make reasonable efforts to match the stain color to existing wood floors. However, due to natural fading and differences in wood texture and finish, perfect color and shine matching cannot be guaranteed.

Gaps and Chips:
Your Floor will install wood filler in all gaps and chips in the wood. Board replacement will only be performed if specified in the estimate. For aged hardwood floors with significant movement, Your Floor will not install wood filler, as it may crack and fall out over time.

Staining Process:
When changing the color of the floors, there may be a need for touch-up painting at doorjambs and step risers. While Your Floor will work as neatly as possible during the refinishing and staining process, it cannot be held liable for any touch-up painting required after the completion of the work.

Finishing:
Please be aware that finishes and stains have strong odors. Depending on the type of finish used and the sensitivity of individuals and pets, it may be necessary for you and your pets to vacate the house during the finishing process to avoid discomfort or health concerns.

·      Finish Curing & Application: The polyurethane finish applied to the floors may take up to 3-4 weeks to fully cure and harden. During this curing period, the Customer is advised to refrain from vacuuming the floors to prevent any damage to the finish. Additionally, it is recommended that the nails of all pets be clipped to avoid scratching or marring the surface of the floor. These precautions are essential to ensure the longevity and durability of the finish.

o   Staining (where applicable): A single coat of stain will be applied, with a drying time of 30-45 minutes when applied by machine. (Natural finishes do not require a coat of stain and will not affect the pricing.)

o   First Coat of Polyurethane Sealer: An alcohol-based polyurethane sealer will be applied with a drying time of 45 minutes.

o   Second Coat of Polyurethane: A second coat of polyurethane will be applied with a drying time of 5-6 hours.

o   Final Coat of Polyurethane: A final coat of polyurethane will be applied with a drying time of 8-10 hours.

·      Dustless System Clause Your Floor utilizes the industry’s leading technology in dust containment to significantly reduce the amount of dust generated during the sanding process. While this system greatly minimizes dust, Your Floor cannot guarantee the complete elimination of dust. Some dust may still be present in the work area despite the use of this technology. The Customer acknowledges that a small amount of dust may be inevitable during the sanding process.

Please note that all finishes used are water-based unless otherwise specified in the agreement.

 


Sandless Refinishing Clause

The Sandless Refinishing procedure offered by Your Floor does not carry any warranty and does not guarantee any specific outcome. This procedure is an attempt to improve the condition of the floors, but its effectiveness may vary based on the current condition of the flooring. If the Sandless Refinishing procedure does not deliver a satisfactory result, a full refinishing or replacement of the floors may be required. In such cases, Your Floor will offer a refund for the Sandless Refinishing procedure in the form of company credit, which can be applied towards the cost of refinishing or replacing the floors.



HVAC/Electrical Requirements Clause

The area in which Your Floor will be working must be climate-controlled. This requirement is not for the comfort of our workers but to ensure proper acclimation and curing of the wood floor and finish coat. Additionally, a 110V and 220V electrical outlet are required for the operation of the sanding equipment. (220V outlets are typically available in laundry rooms or similar spaces.)

In conjunction with the dustless system used by Your Floor, customers can further protect the HVAC system by adding additional filters to the intake vents during the project. Upon completion of the floor work, we recommend that customers replace all HVAC filters to maintain air quality and ensure optimal performance of the system.


Stove & Refrigerator Clause

OPTION 1 (Included in the Quote and Chosen by Most Customers):

  • Stove: Your Floor will not move the stove during the refinishing process. Instead, we will remove the bottom drawer and sand approximately 2-6 inches beneath it. This option is typically chosen by most customers, as the stove is an appliance that is rarely moved.
  • Refrigerator: Your Floor will not move the refrigerator out of the house. Instead, we will move the refrigerator back and forth as the floor is being refinished. This includes rolling the refrigerator out of its place, applying the stain and one coat of polyurethane, and then rolling the refrigerator back into place. Please note that wheel marks may be left under the refrigerator as a result of this process.

OPTION 2 (Customer Responsibility):

  • The Customer will make arrangements for the stove to be moved out of the house during the refinishing process and then moved back in once the work is completed.  Your Floor will charge $300 to move the stove, unless specified in the original quote.
  • The Customer will also make arrangements to empty the refrigerator, move it out of the house, and then return it to its place once the floors are dry. Your Floor will charge $450 to move the refrigerator, unless specified in the original quote.

Moving the Refrigerator:
Your Floor recommends that customers do not move the refrigerator on their own, as there is a high risk of damaging the floors during the process. If possible, please refrain from rolling the refrigerator out of its place to prevent scratching or other damage to the floors.

 


Floor Maintenance

  • All furniture should have floor guards installed to protect the finish of your wood floors.
  • Use Only Homologated Products
  • Do not use any other floor products to clean your floors, other than the ones designed specially for wood floors. For example, acrylic acids causes the wood finish to become dull and wear out rapidly.
  • For floor cleaning products we recommend you visit bona.com. Do not use any products that promote shine or enhancement of the floors.
  • Do not tape anything to the floors for the first 2-3 weeks of the curing period. After the curing period is complete, only use painter’s tape. Please be cautious and make sure the tape is not expired. Your Floor does not cover any damage done by tape.
  • Never use petroleum or bleach cleaners.
  • Limit the water that contacts your floor.
  • Do no wet-mop the wood floors. Standing water can dull the finish of the wood floors and may leave a discoloring spot.
  • Any spills should immediately be wiped.
  • Wear soft shoes. Avoid walking on your wood floors with cleats, high heels or any sports shoes.
  • Lift your furniture when moving.
    • Do not slide any furniture on your wood floors. Try to completely pick up all furniture and then move it.
  • Use a rug in the kitchen. For kitchen floors, it is highly recommended to place a rug in front of the sink.
  • It is recommended in the winter months to use a humidifier in the houses to prevent wood movement and shrinkage to a minimum.
