PERIOD OF PERFORMANCE

Completion days: as estimated on the invoice/estimate.

Estimate could change upon discovery of the need for additional work and/or materials once the project has started. All work is estimated by a total contractual sum; consequently, line items should not be used as price estimates for a particular line item. Any alterations or deviations from the above specifications involving extra costs will be executed only upon written consent by customer and will become an extra charge over and above the estimate. All agreements, contingent upon strikes, accidents, or delays are beyond our control.

COMPENSATION AND PAYMENT

Customer shall pay a deposit of 50% and the remaining 50% must be paid upon completion of the project. If any accounts remain unpaid past a thirty-day period, customer agrees to pay a thirty-five percent collection fee of the contracted amount.

Refund policy: Upon payment received by the seller, all sales are final. No refund or exchange will be issued. All amendments to the contracts must be agreed on and initialed by both parties.

Final Walk Thru: Customer is responsible for performing a walk-thru upon completion of the project. All Punch Lists or concerns MUST be submitted in writing via email (This email address is being protected from spambots. You need JavaScript enabled to view it.) within 48 hours of project completion. All discounts shall be voided should the final balance not be paid within five days from the completion of project. Customer may hold a seven percent retainage of the contracted amount, should there be a Punch List upon completion.

Amendments to the Terms of Service can be made on the estimate by a Your Floor representative.

Progressive payment

Should the project be completed in multiples stages, customer agrees to the following payment plan:

50% Deposit
20% Must be paid after the installation is complete.
20% Must be paid after the refinishing and 2 coats are applied.
10% Must be paid after the completion of the final coat.

Non-Solicitation of Employees/Contractors: Customer agrees that they will not, either during the working period or at any time thereafter, hire nor attempt to solicit or influence any of Your Floor employees or contractors to:

  1. become employees or contractors of, or render services to, homeowner or any other employer or business;
  2. engage in any activity, business or undertaking not sponsored by Your Floor; or
  3. engage in any activity contrary to or conflicting with the interests of Your Floor, while the employee or contractor is employed at or retained by Your Floor.

Binding Effect:  This Agreement shall extend to, shall inure to the benefit of and shall be binding upon all the parties here to and upon all of their respective heirs, successors and representatives. Should customer breech this agreement, customer agrees to a fine of ten thousand dollars.

Your Floor Construction Arbitration Clause 

Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Atlanta, GA 1201 W Peachtree, NW, Suite 2650, Atlanta, GA 30309, before one arbitrator. The arbitration shall be administered by JAMS pursuant to its (Engineering and Construction Arbitration Rules & Procedures) (Engineering and Construction Arbitration Rules & Procedures for Expedited Arbitration). Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Customer agrees to cover all mediation costs. 

FURNITURE:

If customer made arrangements with Your Floor to move furniture, customer is responsible for moving all knick-knacks, paintings that are shoulder height, electronics and breakables. Hutches and china cabinets must be empty. We do not move grand pianos, grandfather clocks or any priceless family heirlooms. These items should be left to a moving professional hired and scheduled by the customer. It is the customer’s responsibility to provide a space for the furniture (most customers use the garage) and to supervise and direct the moving of the furniture. Your Floor will handle all furniture and appliances with maximum care but cannot take liability for any damages that may occur. Contracted furniture price is not negotiable.

Moving Appliances: Your Floor will move and work around appliances with maximum care; however, Your Floor cannot take liability for any damages to appliances during the process. To fully protect appliances from damage, we recommend customer makes arrangements to move out the appliances.

Your Floor does not move sleep number beds.

Liability:  Your Floor will handle all work with maximum care and prudence however, Your Floor does not take liability on any damages to the property. (documenting previous damages and wear&tear is not logistically possible for every project) 

If no arrangements were made with Your Floor to move furniture, customer is responsible for providing an empty working space.

PRE-FINISHED WOOD FLOORS:

When you order pre-finished wood floor through Your Floor, we order an additional 7%-10% of materials to account for waste and we round to the next box of wood. Consequently, customer can potentially have 1-3 boxes of wood floor left over that we recommend you keep for future repairs. If you would like to return any of the leftover boxes you may do so at a 35% restocking fee that our manufacturers charge (returned boxes must be intact).

Your Floor will install products from other retailers or distributors, however Your Floor does not warrant the installation. Customer will have to rely solely on the warranty of the products purchased.

INSTALLATIONS OF WOOD FLOORS:

  • Please note that solid wood floors by their very nature are prone to expansion and contraction as seasons change. As a result, Your Floor does not warrant against expansion and contraction on its wood floor installations.

  • Laminate floors are installed using the floating floor installation guidelines. This means that, they are not glued down but float on top of the sub-floor.  Due to the nature of the installation customer should expect the floor to be softer on their feet and feel a little bit of give as they walk on the floors.
    • Should the sub-floor of any installation be un-leveled, leveling compound can be used at an additional cost.

  • Adding new wood floors:  Please note that all additional wood floors will be added using a t-mold transition unless otherwise specified.

  • Stone Fireplace:  Your Floor will install a picture frame around a stone fireplace and fill the remaining gap between the wood and the stone with mortar. Please note that 100% matching mortar cannot be guaranteed.

  • Squeaky sub-floors: Your Floor will install screws in all areas where our crew notice that there are squeaks.  However, we highly recommend that the customer point out the areas of concern to our crew on site. Your Floor cannot guarantee to eliminate all the squeaks.
  • New Steps Installation and Refinishing: - In all new steps installation, Your Floor will use a solid oak thread that will be stained to the customer’s desire and a quarter inch veneer riser that can either be stained or primed. On all    built-in staircases, Your Floor will install a retro-thread on top and sand and paint the skirt sides with paint  provided by the customer. -  Your Floor will work as careful as possible around the wood or iron spindles without damaging them.  Please note that should any of the spindles need to be changed or replaced Your Floor will offer the labor at no charge as long as customer can provide the new spindles. -  Any additional touch-up paint work needed after the installation or refinishing of steps will be the customer's responsibility.

  • Your Floor will handle all work with maximum care, however Your Floor does not take responsibility for any trim work, cabinetry, or paint damages that were there before or after the floors were installed or refinished.

RESCHEDULING: If you need to change the starting date we do require a 24-hour notice. Failure to provide proper notice will result in a $199 re-scheduling fee.

CONTRACT TERMINATION:  If customer desires to terminate this agreement at any time after it was signed there will be a 10% penalty of the contracted amount. (exceptions: natural disaster, closings dates or life-threatening situations)

REFINISHING:

STAIN SELECTION: For color selection, someone must be present on the first day of sanding to approve the stain color. If you are going out of town, please make an appointment prior to leaving town to select a stain color.

Color matching: Your Floor will do its best to match colors to existing wood floors, however please be aware that due to fading in color and shine perfection cannot be achieved.

GAPS AND CHIPS: Your Floor will install wood filler in all gaps and wood chips.  Board replacement will only be done if it is specified in the estimate.

On all aged hardwood floors that have a lot of movement, Your Floor will not install any wood filler (as it will crack and fall out).

STAINING PROCESS: Please be aware that, especially when changing the color of the floors, there may be a need for touch-up painting at the doorjambs and step risers. Your Floor will work as neatly as possible while refinishing and staining the floors but cannot take liability for any touch-up painting upon completion.

FINISHING: Finishes and stains have strong odors. Depending on the finish and how sensitive you are, you and your pets may not be able to remain in the house during this process.

Your Floor floor finishing and drying process is as follows:

  • 1 coat of stain (where applicable) with a drying time of 30-45 minutes when applied by machine (natural finishes do not need a coat of stain and do not impact pricing)
  • 1 coat of alcohol-based polyurethane sealer with a drying time of 45 minutes,
  • 2nd coat of polyurethane with a drying time of 5-6 hours
  • final coat of polyurethane with a drying time of 8 to 10 hours.

All drying times can only be achieved under proper ventilation and temperature of the house.  All finishes are oil-based unless otherwise specified. STAINING PROCESS: Please be aware that, especially when changing the color of the floors, there may be a need for touch-up painting at the doorjambs and step risers. Your Floor will work as neatly as possible while refinishing and staining the floors but cannot take liability for any touch-up painting upon completion.

Sandless Refinishing:  This procedure does not carry any warranty and it does not promise any sort of outcome.  This procedure is simply an attempt at improving the conditions of the floors.  A full refinishing or replacement of the floors may be needed should this procedure not deliver satisfactory outcome.  Your Floor will offer a refund for this procedure in company credit towards refinishing or replacement of the floors. 

FINISH CURING: The polyurethane can take up to 3-4 weeks to completely cure or to harden. As a result, refrain from vacuuming the floors for this time period and clip the nails of all pets.

HVAC/ ELECTRICAL REQUIERMENTS: The area that we will be working in must be climate controlled; this is not for the comfort of our workers, but rather to ensure proper acclimation and curing of the wood floor and finish coat. A 110V and 220V electrical outlet is required for operation of sanding equipment (220V outlets are usually available in the laundry room).

In addition to the dustless system that Your Floor uses, customers can take further precaution to protect the HVAC system by adding additional filters to the in-take vents. Upon completion of the floors we do recommend that customers replace all HVAC filters.


DUSTLESS SYSTEM: Your Floor is using the industry’s leading technology in dust containment that significantly reduces the amount of dust created during the sanding process. However, Your floor cannot guarantee 100% elimination of dust.

 

STOVE & REFRIGERATOR:

OPTION 1 (included in the quote and chosen by most customers)

Your Floor will not move the stove; rather, we will remove the bottom drawer and sand about 2-6 inches under it. Most customers will go this route, as this is an appliance that rarely gets moved.

Your Floor will not move the refrigerator out of the house; rather, we will move the refrigerator back and forth as the floor is being refinished. This means that we will roll the refrigerator out of its place, apply the stain, one coat of polyurethane, and then roll the refrigerator back in its place. The downside to this option is the wheel marks left under the refrigerator.

OPTION 2

The customer will make arrangement for the stove to be moved out of the house during the refinishing process and then to be moved back in once completed.

The customer will make arrangement to empty the refrigerator, move it out of the house, and then back in its place when the floors are dry.

Moving the Refrigerator: We do not recommend customers move the refrigerator on their own. There is a high chance of the floors being scratched in the process. If possible, refrain from rolling the refrigerator out of its place.

 

Floor Maintenance

  • All furniture should have floor guards installed to protect the finish of your wood floors.
  • Use Only Homologated Products
  • Do not use any other floor products to clean your floors, other than the ones designed specially for wood floors. For example, acrylic acids causes the wood finish to become dull and wear out rapidly.
  • For floor cleaning products we recommend you visit bona.com. Do not use any products that promote shine or enhancement of the floors.
  • Do not tape anything to the floors for the first 2-3 weeks of the curing period. After the curing period is complete, only use painter’s tape. Please be cautious and make sure the tape is not expired. Your Floor does not cover any damage done by tape.
  • Never use petroleum or bleach cleaners.
  • Limit the water that contacts your floor.
  • Do no wet-mop the wood floors. Standing water can dull the finish of the wood floors and may leave a discoloring spot.
  • Any spills should immediately be wiped.
  • Wear soft shoes. Avoid walking on your wood floors with cleats, high heels or any sports shoes.
  • Lift your furniture when moving.
    • Do not slide any furniture on your wood floors. Try to completely pick up all furniture and then move it.
  • Use a rug in the kitchen. For kitchen floors, it is highly recommended to place a rug in front of the sink.
  • It is recommended in the winter months to use a humidifier in the houses to prevent wood movement and shrinkage to a minimum.
